SECTION 11 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, typographical errors, inaccuracies, or omissions may occur in product descriptions, pricing, promotions, shipping charges, delivery times, and availability. We reserve the right to correct such errors and, if necessary, cancel orders without notice.

SECTION 11-bis – COMPLAINTS, ERRORS AND RESOLUTION TIMES (UP TO 60 DAYS)

In the event of errors, mix-ups, or anomalies relating to orders, shipments, deliveries, products received, customizations, or any other phase of the Service (even if the error is attributable to ROMA GEMS/TASTY SRLS), the Customer is invited to report it promptly by contacting customer support at the contact details indicated in SECTION 20, indicating at least: order number, name, contact information, and description of the problem, as well as any useful photos or documentation.

Upon receipt of a complete report (i.e., accompanied by the information required for verification), ROMA GEMS/TASTY SRLS will have up to 60 (sixty) days to carry out the necessary investigations and propose or implement a solution, which may include, but is not limited to: order correction, new shipment, replacement, integration, withdrawal and/or refund, where applicable.

If the report is incomplete or additional information is required, the deadline will begin when the Customer provides the requested information. ROMA GEMS/TASTY SRLS will inform the Customer of the progress of the case and, where possible, the estimated resolution time.

It is understood that this clause does not limit or exclude the mandatory rights granted to the consumer by applicable law (in particular regarding the legal guarantee of conformity and remedies provided by law), which in any case remain intact.

SECTION 12 – PROHIBITED USES

You are expressly prohibited from using the Site and the Service to:

Illegal purposes or to incite illegal activities.
Violate any local, national or international laws, regulations or rules.
Infringe or violate any intellectual property rights or other rights of any third party.
Harass, abuse, insult, defame, disparage, or discriminate against people based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
Transmit false or misleading information.
Upload or distribute viruses or other malicious code.
Collect or track personal data about other users without authorization.

You agree to indemnify, defend and hold harmless ROMA GEMS, TASTY SRLS and their representatives from any claim or demand (including legal fees) arising from your unlawful use of the Service or your violation of these Terms or the rights of a third party, except as permitted by applicable mandatory law.

SECTION 15 – SEVERABILITY CLAUSE

If any provision of these Terms is held to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law without invalidating any remaining provisions.

SECTION 16 – TERMINATION

These Terms will remain in effect until terminated by either you or TASTY SRLS.
You may terminate these Terms by ceasing to use the Site.
If you violate the Terms, we reserve the right to immediately terminate your access to the Service, but you will still be liable for any amounts due up to that point.

SECTION 17 – ENTIRE AGREEMENT

These Terms, together with any notices and policies posted on the Site (e.g., Return Policy/Refund Policy, Privacy Policy), constitute the entire agreement between you and ROMA GEMS, superseding any prior communications, whether oral or written.

SECTION 18 – GOVERNING LAW AND JURISDICTION

These Terms and any agreements related to the Service are governed by and construed in accordance with the laws of Italy.
For disputes with consumers, the competent court is that of the consumer's place of residence or domicile, as provided for by applicable legislation.
For disputes with parties who do not qualify as consumers, unless otherwise agreed in writing between the parties, the court identified according to the general rules of law shall have jurisdiction.

SECTION 19 – CHANGES TO THE TERMS AND CONDITIONS

We reserve the right to update, modify, or replace these Terms by posting any changes on the Site.It is your responsibility to periodically review this page. Your continued use of the site following the Terms' updates constitutes acceptance of the changes.

SECTION 19-bis – NON-RETURNABLE ITEMS AND EXCLUSION OF THE RIGHT OF WITHDRAWAL FOR CUSTOMIZATIONS

Pursuant to art. 59 of the Consumer Code (D.Lgs. 206/2005, as amended by D.Lgs. 21/2014), the right of withdrawal (return for second thoughts) does not apply, among other things, in the cases of:

Custom or made-to-measure products: Items created according to the customer's specific requests, such as engravings, photo-engravings, initials, dates, personalizations, design modifications, or non-standard sizes.
Clearly personalized products: jewelry or gemstones with customizations such as initials, dates, or unique designs.

Therefore, the right of return/withdrawal is not provided by law for customized creations/products, except in cases of defects of conformity or errors attributable to ROMA GEMS/TASTY SRLS, for which the remedies provided by applicable law (including the legal guarantee) remain valid.

For non-personalized products, where sold, the return/withdrawal conditions provided for by current legislation and detailed in our Refund Policy/Return Policy, if available on the site, apply.
